General Liability
Commercial General Liability policies provide protection for negligent acts which result in:
- Bodily Injury
- Property Damage
- Personal Injury or Advertising Injury
These injuries might include a child who is injured while playing at school, a senior citizen who becomes ill from eating food at a senior meal site, or a program participant who slips on a wet floor and breaks a bone.
The named insured on the policy should include the volunteers working for your nonprofit. Coverage for events and fund-raisers should be part of a commercial general liability policy.
The policy excludes such things as lawsuits brought against board members for bad management decisions, lawsuits alleging unfair employment practices or actions of an unprofessional nature such as sexual harassment.
Your nonprofit organization, depending on your mission, may want to add the following provisions to your Commercial General Liability policy:
Social Service Professional: Provides coverage for negligence and errors and omissions as a result of professional and peer counseling activities.
Improper Sexual Conduct: Provides coverage for allegations of sexual abuse and molestation. The policy can include client v. client coverage. Any organization that provides services to youth, developmentally disabled of any age, or senior citizens should consider this type of coverage.
Employee Benefits Liability: Provides coverage for damages from your organization’s negligent handling of the administration of your employee benefits program.
Hired and Non-owned Auto: Provides liability coverage for automobiles that an organization uses but does not own. Hired coverage applies to an automobile on a short-term lease. It does not cover vehicles leased on a long-term basis. Non-owned coverage applies to automobiles used without charge to the organization, such as those owned by volunteers and employees but used on organization business.
Business Auto: Provides liability coverage for automobiles owned by your nonprofit. Liability covers damage to other vehicles or property and injury to others for accidents for which you are at-fault. Physical Damage (Collision and Comprehensive) covers repair of vehicles you own.
Umbrella: Provides higher limits of liability for the underlying coverage or policies listed on the coverage form.
